Dry bulk company Falcon and bunker supplier World Fuel Services have closed a case regarding damages for a low-sulfur fuel delivery to a ship.

Falcon originally sued for damages for USD 500,000 when it turned out that the fuel’s sulfur content was above the cap set by the International Maritime Organization (IMO).

”I can confirm that the case is closed, but I have no further comment,” says Falcon Chief Executive Jakob Borgård Jørgensen to WPO.

According to WPO’s information, the case never made it to court but ended with a settlement.

Bulk company Falcon sues World Fuel Services over off-spec bunker delivery

The case emerged as Falcon sued World Fuel Services over delivering low-sulfur fuel to a ship, which Falcon in late September 2020 had hired on time charter from company W.L. Shipping.

As part of the agreement, Falcon was to pay for the ship’s fuel, which the company hired World Fuel Services to provide.

But a subsequent test of the fuel revealed sulfur contents of 0.53 percent, exceeding the limit of 0.5 percent stipulated by the IMO’s sulfur regulation. This prompted W.L. Shipping to demand that Falcon empty the ship of fuel and tank a new low-sulfur fuel.
