Port of Maceió says it holds valid environmental license until 2027

The Port of Maceió stated in a note released on Wednesday, 8, that its operational activities are duly licensed and supported by environmental license No. 2023.04101440861.EXP.LOR, issued by the Alagoas Environment Institute (IMA-AL).

According to the administration, the document is valid until October 2027. The statement came after the Federal Public Prosecutor’s Office (MPF) recommended that the port comply with federal environmental regulations within 90 days.

According to the MPF, the Port of Maceió is operating without environmental licensing from Ibama, in violation of federal legislation.

In response, the administration stated that the enterprise has been conducting uninterrupted licensing since 2018, with all renewals approved following rigorous technical and environmental analysis.

The note also states that the port complies with “all the conditions provided” and that the divergence between Ibama and IMA-AL concerns administrative competence for licensing, and not the port’s operation.

“The enterprise has carried out uninterrupted licensing since 2018, with all renewals approved after rigorous technical and environmental analysis,” says a section of the statement.

The administration also reported that it completed the Activity Characterization Form (FCA) with Ibama and maintains constant dialogue with the State Superintendence and the agency’s headquarters in Brasília, seeking a consensual technical solution.

The MPF’s recommendation was prepared by federal prosecutor Érico Gomes, based on a civil inquiry investigating the operation of the port without a valid license from the federal environmental agency.

The MPF instructed the Companhia Docas do Rio Grande do Norte (Codern), responsible for the administration of the port, and IMA-AL to send all documents and necessary information to Ibama for regularization.

According to Federal Decree No. /2015, the licensing of organized ports is under the jurisdiction of the Union, through Ibama. However, the Port of Maceió has been operating under a license issued by a state agency, which has created the legal impasse and led to the MPF’s recommendation.
