These institutions share the responsibility of avoiding potential adverse effects on the Environment and Human Health.The Ship Dismantling Regulation, which came into force by being published in the Official Gazette dated /2004 and numbered 25396, was prepared by considering the current situation, problems and targets of the Ship Recycling sector of the period and has been useful in regulating our ship recycling industry, which is an example in international platforms. The provisions of this Regulation are carried out by the Ministry of Transport and Infrastructure.The center of the ship recycling industry in our country is in İzmir-Aliağa due to the operating permits given, and it is known that as of today, 22 facilities continue to operate actively in the allocated region. Ships and marine vehicles (cargo ships, passenger ships, tankers, tugboats, barges, platforms, warships, etc.) with a steel weight of approximately 900,000 tons annually are dismantled here. It is stated that our shipbreaking industry, which is a labor-intensive industry, provides direct employment to 1,400 people as of 2020, with the help of the technical supports provided, the initiatives and efforts to achieve international reputation. Considering the ship and machinery sub-industry and the iron and steel and other sectors of which it is a supplier, it is also considered that this figure allows indirect employment by several times. It is observed that the facilities operating in the region are heavily on the agenda.Ship recycling, which is seen as an important industry branch, is one of the components of local and national economies in some countries, including five countries that process approximately 97% of the world’s scrap ship tonnage, including our country. The market to which this industry depends and the /operation of this market are essentially affected by the social economic structuring of the maritime transport and iron and steel industries.Despite its current benefits, the ship recycling industry is also faced with many problems that need to be solved with the effect of increasing public awareness in the fields of environment, health and work safety. International answers for the solution of problems are tried to be given by international organizations such as International Maritime Organization (IMO), United Nations Environment Program (UNEP), International Labor Organization (ILO).The adoption of the IMO’s “Hong Kong Convention for the Safe and Environmentally Responsible Recycling of Ships” is an important milestone in this industry. In a short time, the Hong Kong Convention, which was adopted as a widely accepted tool to regulate the industry on a global scale, started to affect the regulations of the governments at the highest level as well as ship recycling facilities, ship owners, shipbuilders. In the near future, ship recycling activities will have to adapt to this global regulation.In addition, the European Union’s decision prohibiting the export of hazardous wastes to non-OECD countries, the Basel Convention and the Waste Shipment Regulation in the European Union legislation, which is the equivalent of the prohibition Decision, do not contain an applicable mechanism for scrap ships. It has been determined by the EU Commission that 91% of European ships avoid the above-mentioned legislation and turn to different and undesirable solutions.Understanding that the Basel Convention cannot adequately regulate the recycling of ships, and with the concern that the entry into force of the Hong Kong Convention will be delayed, the European Council, in agreement with the EU Parliament, adopted the Ship Recycling Regulation on 27 June 2013 regarding the regulation of applicable sanctions in the interim period. The Ship Recycling Law was approved at the main meeting of the EU Parliament and was adopted as of 30.12.2013.With the EU Ship Recycling Regulation, it seems that it is aimed to reduce the negative safety and environmental effects that may occur during the recycling of EU Flagged ships without creating an unnecessary economic burden. This Regulation allows EU Flagged ships to be legally recycled at facilities located in countries other than OECD countries, by providing minimum environmental and safety conditions. Ship owners can select the facilities that meet the ship recycling criteria from the European Ship Recycling Facilities List.8 of the 22 facilities in İzmir Aliağa are included in the European Ship Recycling Facilities List in accordance with the Implementation Decision (EU /691) of the EU Commission dated 28 April 2022 and the Regulation (EU) No /2013 of the European Parliament and the Council. takes. It is seen that the company that has undertaken the dismantling of the NAe Sao Paulo ship in Aliağa is also included in the European Ship Recycling Facilities List.In the Current European Ship Recycling Facilities List; 1 from Belgium in the EU member countries category; 6 from Denmark; 1 from Estonia; 2 from Spain, 4 from France, 1 from Italy, 1 from Latvia, 4 from Lithuania, 5 from Netherlands, 8 from Norway, 1 from Finland, 1 from UK-Northern Ireland and Third 8 from Turkey in the category of Parties; There are a total of 46 shipbreaking facilities, 2 from the UK and 1 from the USA. In this list, it is seen that there are no facilities from Bangladesh, India, Pakistan and China, which are the countries in Asia where approximately 85% of the shipbreaking activities are carried out worldwide. We consider that one of the prominent reasons why no choice was made from other Asian countries regarding the dismantling of the NAe Sao Paulo ship is that the company that will do the dismantling is included in the European Ship Recycling Facilities List.In order to be included in the EU Ship Recycling Facilities List, first the application of the relevant enterprise and then being subject to inspection by a conformity assessment body authorized by the EU Commission, the result of the inspection must be suitable for inclusion in the list.Scrap ship dismantling and recycling operations require the necessary activities and practices to be carried out by taking into account the elements that cause pollution in terms of environment and human health, and by eliminating the risks that may arise. Asbestos or asbestos-contaminated materials, other different types of wastes and substances (heavy metals, mineral oils, materials that may contain or are contaminated with dangerous chemical compounds, packaging, batteries containing nickel and cadmium, batteries containing lead, which are more common in ships aged approximately 20 years and over) liquid petroleum derivative fuel residues, etc.) during dismantling operations, it is critical to prevent the scattering of pollutants in water resources, air and the environment, and to carry out the operations under the supervision and control of the responsible administrative authorities.As a country, we are a party to the “International Basel Convention on the Cross-Border Transport and Disposal of Hazardous Wastes and the Hong Kong International Convention on the Safe and Environmentally Friendly Recycling of Ships” and the legal regulations we have put into effect in accordance with these agreements and other requirements, human health in practice, It must be carried out and operated in a way that does not pose a risk to work safety and the environment. Within the framework of the regulations to which we are a party, in cooperation and coordination of our public boards and organizations1. Inventory of the dangerous goods inventory in the dismantled ships, and the removal of the dangerous wastes in accordance with the national and international regulations to which we are a party in the pre-dismantling process should be supervised and supervised.2. The detailed preparation of the recycling plan of each ship and marine vehicle should be observed and inspected.3. In the recycling plans, the disposal of hazardous materials that cannot be recycled or their storage in a way that does not harm the environment should be clearly included within the framework of national and international regulations. Dismantling processes and activities should also be subject to surveillance and control in accordance with current regulations and life and environmental safety requirements.5.
