Latrofa: the ruling allows the release of funds set aside that have frozen the budget for years
The Port System Authority of the Northern Central Tyrrhenian Sea announced that the Rome Court of Appeal, regarding the dispute initiated by Grandi Lavori Fincosit for the recognition of compensation for the first phase of strategic works at the port of Civitavecchia, with a ruling published this morning, further reduced the amount the port authority will have to pay, which will now be less than 1% of the original claim. The AdSP recalled that the case, of significant economic and strategic importance, stems from works and contractual relationships dating back years and saw the counterparty advance a total compensation claim of €209.8 million. In the first instance, the court had already granted only a minimal part of GLF’s requests, ordering the AdSP to pay approximately €1.7 million plus interest, an amount already far lower than the sums originally demanded. With today’s decision, the Court of Appeal partially upheld the first and seventh grounds of appeal raised by GLF but also upheld the first ground of cross-appeal filed by the Port System Authority, thereby determining a further 20% reduction of the amount awarded in the first instance. The total amount owed by the AdSP now stands at €1.5 million plus interest.
“The publication of this ruling,” emphasized the extraordinary commissioner of the AdSP, Raffaele Latrofa, “represents an important and highly positive moment for our Authority. Reducing the payout to less than 1% of what was initially demanded by the counterparty means having conducted a solid and forward-looking defense.” “This ruling,” he added, “allows the release of funds set aside that have frozen the budget for years and that can now be used for the development of the three ports.
