The Western Australian Court of Appeal has dismissed an appeal by Malaysia-based Bumi Armada relating to the Malaysian company’s claim against Australia-based Woodside over a 2016 FPSO contract termination. The case was lost in a lower court and has now been dismissed again.
Bumi Armada subsidiary Armada Balnaves commenced legal proceedings against Woodside Energy Julimar in March 2016 after Woodside cancelled its contract for offshore processing ship Armada Claire (IMO 9052393).
The company had claimed that Woodside’s notice of termination constituted a breach of contract. It claimed damages of $283.5m.
In January 2020 Bumi Armada had its claim against Woodside dismissed. The company appealed the decision, with the Western Australian Court of Appeal hearing the appeal in July 2021. The FPSO had been operating in the Balnaves Field, off north-western Australia.
1993-built, Marshall Islands-flagged, 62,956 gt Armada Claire is owned by Armada Balnaves Pte Ltd of Singapore. It is managed by Bumi Armada Bhd of Kuala Lumpur, Malaysia. ISM manager is Bumi Armada Australia Pty Ltd of Perth, Western Australia. It is entered with Standard Club (Standard Offshore Division) on behalf of Armada Balnaves Pte. No AIS since May 11th, when it was at Galang Anchorage, Indonesia.
