Following the decisions made by the FAI associates of Salerno in the meeting held on November 27, 2025, a note from FAI Campania-Roma reiterates and formalizes the immediate application of the current regulations concerning compensation for delays in transport, in accordance with the provisions of Decree Law No. 73 of May 21, 2025, converted with amendments by Law No. 105 of July 18, 2025.
1. General Compensation Regime It is reminded that, for every hour /or fraction of an hour of delay beyond the free time provided for by Art. 6-bis of Legislative Decree /05, compensation of € 100.00 (/00 euros) must be paid.
2. Specific Provision for the Port of Salerno: Introduction of the Port Fee Surcharge
In consideration of the chronic congestion and the need to streamline calculation procedures for waiting times at the Port of Salerno, which systematically exceed the free time limits, the introduction of the Port Fee Surcharge is announced.
Effective application date: January 1, 2026
The amount of the Port Fee Surcharge, set at € 100.00 (/00 euros), is fixed on a permanent basis for each container pickup /or delivery operation at the Port of Salerno and the affected inland ports.
➢ Payment: This amount will be paid as a fixed sum, taking into account the chronic congestion of the port.
➢ 2. Contractual Agreements: In respect of the contractual autonomy between the parties, and considering the possible complexity in the port area of calculating waiting times as defined by the Law, the availability to contractually define models that specify in more detail the compensation regime for stops, integrating the provisions of the law, is confirmed.
The adoption of these measures is aimed at ensuring the safety and punctuality of road haulage activities
