Key witnesses are no show in spectacular fraud case

The Danish Attorney General’s office for fraud and economic crimes – generally known as the Danish Fraud Squad (SØIK) – was forced to cancel a crucial court hearing in a spectacular criminal court case against a Danish bunker company which is protected by court-ordered anonimity.

The court session was set to take place on Friday at the court in Kolding, but the court informs Finans that it has been canceled because the two scheduled witnesses were both unable to make an appearance.

The two individuals can be described as key witnesses for the economic crimes unit in the case in which the oil company and two executives are charged with systematic fraud against the Malaysian company Pacific Inter-Link by billing the carrier for greater amounts of fuel than were actually delivered.

One of the two key witnesses represents Pacific Inter-Link while the other is a former employee of the Danish oil company.

The Court in Kolding informs that the former is ill, while the previous employee, who now lives in Dubai, is apparently experiencing issues with his passport.

According to the court, the Danish Fraud Squad has stated, however, that there is no reason to assume that the two witnesses cannot show up at another point in time.

Pacific Inter-Link was the one to originally file the case with the economic crimes unit, but the company retracted the accusations explaining that the situation had been investigated further and the Danish oil company had also been able to show comprehensive documentation.

What Pacific did not mention was that a settlement had been made shortly prior to the retraction and the Danish oil company had paid USD 3.8 million.

WPO and Finans have tried to get a comment from the defense attorney of the oil company and have also been in touch with the former employee.

He has no comments, and neither does the Danish Fraud Squad.

The case will now continue on June 29th instead.
